Haustore offers its customers the option of installing their products purchased on our website, haustore.es, through an online assessment or by request. Haustore will use both its own installers and subcontracted installers to carry out the installation of its products. All of these professionals are accredited by the product manufacturers as authorised installers.

PARTIES AND ACCEPTANCE OF THE CONDITIONS

✔ On the one hand, the supplier of the products, Haustore (hereinafter, “Provider”) owner of the website www.haustore.es, sets out the conditions under which the contract for the sale of products will be formalized through the website.

✔ On the other hand, the User-client (hereinafter, “User”).

Both parties accept this document and it commits the User to:

By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts. You agree to be bound by these Terms.

You assume all obligations set out herein and use this website only to make legally valid enquiries or orders.

You do not place any false or fraudulent orders. If it could reasonably be considered that an order of this nature has been placed, we will be entitled to cancel it and inform the relevant authorities.

You provide us with your email address, postal address and/or other contact details in a truthful and accurate manner. You also agree that we may use this information to contact you if necessary (see our Privacy Policy). If you do not provide us with all the information we require, we will not be able to process your order.

By accepting these purchase conditions, you are jointly accepting all documents mentioned therein, such as the shipping conditions, return conditions and exceptions to them, privacy and cookie policies, among others.

✔ Haustore reserves the right to modify the GTC at any time and without prior notice. The GTC will always be accessible from the website, so that the user can consult or print them at any time.

✔ The prices and conditions of sale are merely informative and may be modified in response to market fluctuations. However, placing an order by completing the purchase form implies acceptance of the price offered and the general conditions of sale in force at that specific time, except for a manifest error in the price.

✔ In the event that Haustore identifies a manifest error in the price of any of the published Products, it will immediately inform the Customer, as well as carry out the corresponding publication of the correction through the Website, with the Customer having the option of reconfirming, through the “My Account” section, their order at the correct price or, failing that, canceling it.

✔ Once the order has been formalised, without any obvious error identified, the purchase will be deemed to have been completed by full right, with all the legal guarantees that protect the purchasing consumer and, from that moment, the prices and conditions will have a contractual nature and may not be modified without the express agreement of both contracting parties.

✔ The electronic document in which the contract is formalised will be archived and the user will have access to it in their customer area. Haustore is not responsible for any consequences, damage or harm arising from access to this website, use of the information on it or access to other materials on the Internet through connections to it.

✔ The intellectual property rights over all elements included in this website, such as, but not limited to, titles, photographs, designs, melodies, applications and others, belong exclusively to Haustore. Access to this website does not imply authorisation for its use, and such unauthorised use may result in corresponding civil and/or criminal liability.

✔ Any references made on this website to any product, service, process, link, hypertext or any information using the trademark, trade name or manufacturer or supplier, etc. that are owned by third parties do not constitute or imply endorsement, sponsorship or recommendation by Haustore.

PRODUCT AVAILABILITY

All orders are subject to product availability. If there are any difficulties in supplying products or if items are out of stock, we will refund any amount you may have paid. You will also have the option of selecting an alternative item, with similar characteristics to the previous item replaced.

SHIPPING CONDITIONS AND DELIVERY TIMES

Delivery times are specified for each product. In rural areas far from urban centres, it is not possible to guarantee delivery within 24 hours under any circumstances. Delivery times will depend on the availability of each product, which is indicated on each and every product offered. There are circumstances arising from the personalisation of the products, or unforeseen or extraordinary circumstances that may affect the delivery date. If for any reason we are unable to meet the maximum estimated shipping date, we will give you the option of keeping your order by setting a new shipping date or cancelling the order with a full refund of the price paid. This does not affect orders for exclusive or custom manufacturing, which may suffer manufacturing or shipping delays once manufactured; and therefore it is not possible to cancel the contract due to a delay not attributable to Haustore.

IMPOSSIBILITY OF DELIVERY

If it is impossible for us to deliver your order, we will try to arrange a second delivery with you. If you are not going to be at the delivery location at the agreed time, please contact us to arrange delivery on another day. Likewise, we do not assume any responsibility for the impossibility of delivery due to the introduction of false, inaccurate or incomplete data by the User.

✔ If 15 days have passed since your order is available for delivery, and the order has not been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the contract and we will consider it terminated.

✔ In the case of a custom-made or exclusively manufactured product, no payment received by the buyer will be refunded, and the buyer will be authorized to pass on the additional costs of transport derived from the termination of said contract.

✔ In the case of the rest of the standard products and as a consequence of the termination of the contract, we will return all payments received from the buyer, including delivery costs, without any undue delay and, in any case, within a maximum period of 14 days from the date on which we consider the contract to be terminated. We will be authorized to pass on any costs arising from the depreciation of the goods due to damage during transport and/or additional transport costs arising from the termination of the contract and reduce them from the total amount of the refund.

CUSTOM MADE, ORDERED OR SPECIAL MANUFACTURE

At HAUSTORE, a large part of its products are CUSTOM MADE where, in accordance with these conditions and the indications in said section, certain systems, fabrics, configurations, technical aspects and functionalities selected by you can be personalized. In said section you can find more information regarding said service.

✔ Customized CUSTOM MADE products are excluded from the Right of Withdrawal according to article 103 c) of the General Law for the Defense of Consumers and Users Royal Legislative Decree 1/2007 of November 16.

✔ Customized EXCLUSIVE AND ORDERED products are excluded from the Right of Withdrawal according to article 103 c) of the General Law for the Defense of Consumers and Users Royal Legislative Decree 1/2007 of November 16.

✔ Products that are not suitable for return due to health protection or hygiene reasons are excluded from the Right of Withdrawal according to article 103 c) of the General Law for the Defense of Consumers and Users Royal Legislative Decree 1/2007 of November 16.

You must bear in mind that, due to technical or other reasons beyond our control, the colors and fabrics may vary from those shown on your screen. Also, you must bear in mind that, as these are personalized items, it will not be possible to return or exchange personalized products.

Products that are not suitable for return due to hygiene reasons or for sale on request will be indicated on the product sheet clearly and unequivocally. You will not have the right to a return under any circumstances. You guarantee that you are happy to use the elements that form part of the customization of the products. While we reserve the right to refuse your customization or cancel orders for customized products for failure to comply with these terms, you will be solely responsible for the customization you request. We do not assume any obligation to verify, nor do we assume any responsibility for, the elements that form part of the customization created by Users of this service.

RIGHT OF WITHDRAWAL

RETURNS POLICY

If you are contracting as a private consumer, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days after the day on which you or a third party authorized by you, other than the carrier, acquired material possession of the goods or, in the event that the goods comprising your order are delivered separately, 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the last of those goods.

✔ The exercise of the right of withdrawal is limited solely to the supply of "Standard" products, as these are products that are not made according to the User's specifications or to order, such as exclusively manufactured products. For the rest of the products, due to their very nature, the right of withdrawal will not be possible.

✔ To exercise the right of withdrawal, you must notify HAUSTORE of your decision to withdraw from the contract by means of an unequivocal statement and by email to the address info@haustore.es. You may use the withdrawal form template that appears as an Annex to these Conditions, although its use is not mandatory. To comply with the withdrawal period, it will be sufficient for the communication regarding the exercise by you of this right to be sent before the corresponding period expires.

Consequences of withdrawal

In the event of withdrawal on your part, we will refund all payments received from you, including delivery costs, without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make said refund using the same means of payment used by you for the initial transaction. You will not incur any costs as a result of the refund. Notwithstanding the foregoing, we may withhold the refund until we have received the goods and checked their condition. You must bear the direct cost of returning the goods in perfect condition. You will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

Once the product withdrawal form has been sent within the legally established period, we will have to check whether the product to be returned complies with the legal exceptions established in this contract and its return is appropriate.

In any case, you must return the product without any undue delay to our warehouses (Haustore - c/Antonio López, 6 28019 Madrid - Spain) and, in any case, within a maximum period of 14 calendar days from the Exchange Request. The return shipping costs will be your responsibility.

Please return the item using or including all its original packaging, instructions and any other accompanying documents in order to avoid a depreciation of the item. After examining the item and verifying that it is not damaged, you will be entitled to a refund of the amounts paid. The refund will always be made in the same payment method that you used to pay for the purchase.

Returns of defective products

In cases where you consider that at the time of delivery the product does not comply with the contract, you must contact us as soon as possible via email, providing the order details and describing the defect or lack of conformity of the product. The product can be returned by handing it over to a courier that we will send to your home when you request collection. If you do not have the original packaging, you can return your order in any other packaging, as long as it is well sealed to prevent loss of the items or damage to them. We inform you that we do not offer the delivery or return service to countries abroad, so you must take charge of the transport to our facilities for orders you wish to return, whatever the reason for the return. We will proceed to carefully examine the returned product and will inform you whether or not we accept the lack of conformity via email within a reasonable period of time. If the claim is not successful, you will be responsible for all shipping costs incurred, in addition to those incurred for returning the product to your home. If the claim is successful, the refund, repair or replacement of the item will be made as soon as possible and, in any case, within 14 days from the date on which we send you an email confirming the validity of your claim. The amounts paid for those products that are returned due to a defect or fault, when it actually exists, will be fully refunded, including the delivery costs incurred to deliver the item to you. The refund will be made in the same payment method that was used to pay for the purchase.

APPLICABLE LAW AND JURISDICTION

The applicable law in the event of a dispute or conflict of interpretation of the terms that make up this Legal Notice, as well as any issue related to the services of this Portal, will be Spanish law.

For the resolution of any conflict that may arise on the occasion of the visit to the Website or the use of the services that may be offered therein, NUEVAS GALERIAS RETAIL and the User agree to submit to the Judges and Courts of the User's domicile, provided that the User is located in Spanish territory and acts as a consumer. Otherwise, submission will be to the Courts and Tribunals of Madrid, Spain.
